County Court Orders

The records below focus on orders involving the following persons. I have endeavored to find all orders involving them from the establishment of Livingston County on 21 May 1799 until Eddyville and surrounds became part of newly formed Caldwell Co. 1 May 1809. Because the records are not indexed, and are handwritten and difficult to read, some were no doubt missed.

Gideon Dyer Cobb Moved to Eddyville from Fair Haven, Vermont as part of the party organized by Matthew Lyon about 1800, with his wife Modena Chittenden Clark, and their eldest son, Caleb.
Samuel C. Clark Lived with Gideon, and is assumed to be a relative of Gideon's wife, but that is unproved.
Matthew Lyon Organizer of the move to Eddyville, second husband of Modena (Clark) Cobb's sister Beulah.
Elijah G. Galusha Cousin to Modena (Clark) Cobb; son of her aunt Beulah Chittenden by her first marriage.

Record of some other associates are included, along with mentions of some of the individuals involved in the transactions listed, but those should not be considered complete.

27 Nov 1799 A 27-8 Power of Attorney from David Walker of Jessamine Co. to Charles Stewart of Logan Co. for purpose of selling Walker's lots in Eddyville and take bond for payment in money, tobbacco or hemp by 1 Feb 1801; purchaser must give bond with appropriate security in cash or tobacco or hemp at the Nashville case price; where security is unknown to Stewart he will call on two or three of the most reputable by standers for information [margin note: Deld to to G D Cobb 13 Nov 1810]

7 Jul 1801 A 103 Writ of ad quod damnum issued for water saw mill by Samuel C Clark on his land on Eddy Creek, sheriff to summon twelve fit persons to the premises on 22nd of present month to condemn lands above and below.
4 Aug 1801 A 108 David Walker appeared to acknowledge his deed to Matthew Lyon; ordered to be recorded
5 Aug 1801 A 114-5 Jury finds Samuel C Clark mill dam will not overflow lands, mansion houses, offices, curtalages, gardens, or orchards of others nor will passage of fish or navigation be injured; do not undertake to say whether the health of neighbors will be annoyed or not. Clark given leave to build the mill.
2 Nov 1801 A 127 Samuel C Clark appointed survey of road from Eddyville to Eddy Creek.
3 Nov 1801 A 128-9 Jury on Condemnation for James McNabb water grist mill reported 16 Oct 1801; jury included M Lyon and John M Troop
7 Dec 1801 A 135 David Walker produced a receipt from John Prince & Matthias Cook for $500 which he has contributed towards the publick buildings and therefore is discharged as to that part of his contract.6 Jan 1802
7 Dec 1801 A 136 David Walker "…deposed and saith that directly or indirectly by promises or otherwise he has not given to the Justices or other of those any money, goods, or other property for the permanent Establishment of the seat of justice for Livingston County in Eddyville and that he is at all times ready to account for all the property in the said Town that he has disposed of to any member of the bench of said County."

1 Mar 1802 A 160-1 Report of the viewers of the road from Eddyville to the yellow banks returned; to be established as a public road; John Prince appointed surveyor one half mile and Gideon D Cobb the remaining part.
1 Mar 1802 A 161 Gideon D Cobb granted license to keep ferry at his own house on Cumberland River.
7 Jun 1802 A 176 Ordered ear mark of Samuel C Clark recorded as a space out of each ear.
1 Nov 1802 A 193 Essen Capshaw, James Adams, Thomas Delany, Robert Adams & John Dodd to view and mark road from Cobbs ferry to mouth of Cumberland.
6 Dec 1802 A 198 grant no. 531 – Griffin Long 400 acres
3 Jan 1803 A 201 Report of the viewer of the road from Cobbs ferry to the mouth of the Cumberland River returned; to be established as a public road; Erwen Capshaw appointed surveyor from Sugar Creek to Bullards, and James Adams from Sugar Creek to Cobbs ferry.
3 Jan 1803 A 202 David Davidson entered into bond for $10,000 with Matthew M Gooch, James Miller, Gideon D Cobb, William Belden & William Bond as securities for collecting and paying the public revenues for 1802.
3 Jan 1803 A 210 Report of viewers of road from Cobbs ferry to the mouth of the Cumberland returned; to be established as a public road; Essen Capshaw surveyor from Sugar Creek to Bullards and James Adams from Sugar Creek to Cobbs ferry.
6 Jun 1803 A 217-8 Enoch Prince appointed Clerk of the County Court; entered into bond for £1000 with William Prince & Matthew Lyon his securities.
7 Jun 1803 A 229 Samuel C Clark appointed surveyor of the road from Eddyville to Lick Creek.
7 Jun 1803 A 229 Charlie Miller, Captain John Jones, John Scott & Jamey Barry appointed to view and mark road from Cobbs ferry to intersect Christian Road at or near John Millers.
5 Jul 1803 A 237 On petition of sundry inhabitants of the County, ordered that the viewer of the road from Cobbs ferry to John Millers not to proceed
7 Nov 1803 A 256 Hanson Cattell and John W Troop recommended to the Governor to fill the office of Justice of the Peace from Eddyville
7 May 1803 A 285-7 Report of the commissioners appointed by act of the General Assembly of the Commonwealth of Kentucky entitled An act for the removal of the seat of justice in the County of Livingston was returned. A commission determined the location deemed to be centre of the inhabitable part of the County, exclusive of the Indian lands, where the road from William Princes dwelling to James Retcheys crosses Livingston Creek. That place ordered to be made public ground for the seat of justice and public buildings.
  B   Note: Book B repeats the record of Courts from 6 Jun 1803 through the middle of the 8 May 1804 session, in some cases using somewhat different wording than used in Book A for the same records.

2 Jul 1804 B   Prison rules for the county assigned as an area starting at the jail, through several points, one being a point on the street that leads to the river on the back of where Gideon D Cobb now lives.
3 Jul 1804 B   Gideon D Cobb permitted to keep tavern at his home in town of Eddyille for one year.
4 Jul 1804 B   Henry Doom appointed to survey road to Cobbs ferry from Eddyville to where the road crosses the sinking branch and Bingh Hail from there to the Ferry
4 Jul 1804 B   Chittenden Lyon appointed surveyor of the to Christian Court House.
4 Jul 1804 B   Saml Clark, John Mercer & John Prince appointed to examine the plank that James Ivey is ordered to return.
3 Oct 1804 B   Gideon D Cobb & James Gable recommended for Magistrate for the town of Eddyville in the room of Hanson Catlett resigned.
7 Nov 1804 B   Thomas Gist appelant vs Matthew Lyon appelee; $10 & costs; ordered Gist to pay William Baxter & John Shillings their expenses for their 3 days attendance as a witness for him against Lyons.
3 Dec 1804 B   Andrew George, John George, John Rop, Henry Doom & Griffen Long appointed to mark & view a way for a road from Wm Princes to Cobbs Ferry
4 Dec 1804 B   Richd Jones, Saml C Clark, Eligah G Galusha, Isaac Bullard & Gideon D Cobb appointed to review and mark a way for a road Cobbs ferry to [unreadable].

8 Jan 1805 B   Elijah G Galusha & Jas Gamble recommended as proper person to fill office of Justice of Peace.
1 Apr 1805 B   Commission received from Gov. Christopher Greenup appointing Elijah G Galusha as Justice of th Peace for Livingston Co.
2 Apr 1805 B   Ordered sheriff to advertise for bids for the public buildings agreeable to the plan to be drawn off and furnished by Gideon D Cobb and Will Birdsong.
2 Apr 1805 B   Saml C Clark appointed jailor in the county; Gideon D Cobb & John Mercer security for $2000.
2 Apr 1805 B   Enoch Prince resigned as trustee of Town of Eddyville and E G Galusha appointed to fill the vacancy.
6 May 1805 B   Stephen Miller appeared on charge of begetting a bastard child upon the body of Elizabeth Hannah; not being represented by counsel case continued to next Court; acknowledged indebted to the Governor of the Commonwealth, Miller for £20, & Joseph Miller his security for £10, in goods & chattels, lands & tenements, unless Stephen appear in Court first Monday in July.

8 Oct 1805 B   Stephen Miller appeared on charge of begetting a bastard child upon the body of Elizabeth Hannah; ordered to pay $25 for 4 years, to be paid $12½ every 6 months, to James Diacon who is to see it properly applied; child to remain with the mother; Miller & Charles Miller his security bonded themselves for $200 in goods & chattles, land & tenements; Miller to pay costs of prosecution.
